Genee Terms of Service
Effective date: 9 October 2026. These Terms replace the Terms of Service dated 11 November 2024.
Version: 1.0
In short: these Terms are the agreement between you and Genee when you use Genee as a client. Each section starts with a plain-English summary like this one. The summaries help you read; the numbered text is what binds.
Who these Terms bind. These Terms of Service (the "Terms") are a binding agreement between you and Genee Coaching, LLC ("Genee", "we", "us"). They apply when you visit genee.coach or genee.app, create an Account, practice with an AI Partner, book or attend a session with a Coach, or buy a Plan. If you are a Coach, the Coach Agreement and its Recording and Platform Addendum also apply to you.
Other documents that form part of these Terms. The Privacy Policy and the Session Recording and AI Notes Terms are part of these Terms. If they conflict with these Terms, the Session Recording and AI Notes Terms govern recordings, transcripts and AI notes; these Terms govern everything else.
Defined terms. In these Terms:
- "Account" means the account you create to use the Service.
- "AI Partner" means a character played by Genee's software for practice, in voice or text, with or without an animated face. An AI Partner is not a person.
- "AI Practice" means practice conversations with an AI Partner, the feedback and scores the Service produces, and Genee's AI assistant.
- "Coach" means an independent professional coach approved by Genee and listed on the Service.
- "Coaching Session" means a live video session between you and a Coach on Google Meet, booked through the Service. A "Plan Session" is a 45-minute Coaching Session included in a Plan; an "Intro Call" is a free 30-minute first call with a Coach; a "Paid Session" is a single Coaching Session you buy separately.
- "Content" means anything you submit to or create through the Service, including audio, video, text, messages and files.
- "Output" means anything the Service generates for you with AI, including AI Partner replies, feedback, scores, summaries and AI-drafted notes.
- "Plan" means a monthly subscription listed on the pricing page.
- "Practice Minutes" means the minutes you spend in AI Practice conversations, counted by Genee's servers.
- "Recorded Session" means a Coaching Session recorded by the Notetaker under the Session Recording and AI Notes Terms.
- "Service" means Genee's websites, apps, AI Practice, coach marketplace, Coaching Session tools and related services.
1. The Service
In short: Genee helps you grow at work through AI practice and live sessions with human Coaches.
1.1 What Genee provides. The Service lets you (a) practice conversations with AI Partners and receive feedback, (b) find, book and meet Coaches, and (c) keep a record of your goals, sessions and progress.
1.2 Changes to the Service. We may add, change or remove features. If a change materially reduces what your paid Plan includes, we will tell you at least 30 days before it takes effect, and you may cancel and write to support@genee.coach for a pro-rated refund of the unused part of the current billing period.
1.3 Availability. We aim to keep the Service available at all times but do not promise it will be uninterrupted. Scheduled maintenance is announced in the Service where possible.
2. Eligibility and Age
In short: Genee is for adults. You must be 18 or older.
2.1 Minimum age. You must be at least 18 years old to create an Account or use the Service, including AI Practice and the try-it-out experience. Sign-up does not yet ask you to confirm your age; from 12 October 2026 it will. Until then, by creating an Account you tell us that you are 18 or older.
2.2 Accounts of minors. If we learn that an Account belongs to someone under 18, we will close it and delete its Personal Data as described in the Privacy Policy. Parents or guardians who believe a minor is using Genee can write to privacy@genee.coach.
2.3 Other limits. You may not use the Service if we have previously closed your Account for breaching these Terms, or if the law where you live prohibits it.
3. Your Account
In short: keep your sign-in safe, keep your details accurate, and tell us if something looks wrong.
3.1 Creating an Account. You may sign up with an email address and password, or with Google. If you sign up with an email address on our website or in the app, we email you a 6-digit code that you enter before you finish signing up; if you join through the try-it-out experience, we email you a confirmation link instead. If you sign up with Google, we rely on Google's verification of your address instead. From 12 October 2026, before you use free Intro Calls or the free trial, we may also ask you to confirm your email address with a code (Section 8).
3.2 Accurate information. You agree to give accurate information and to keep it up to date.
3.3 Security. You are responsible for keeping your sign-in details confidential and for activity under your Account. Tell us at once at support@genee.coach if you believe your Account has been used without permission.
3.4 One person per Account. An Account is personal. You may not share it or let anyone else use your Plan, Intro Calls or Practice Minutes.
3.5 Closing your Account. You may ask us to close and delete your Account at any time from your profile ("Delete my account") or by writing to support@genee.coach. We complete deletion within 30 days, as described in the Privacy Policy. If a Plan is still set to renew or a Coaching Session is upcoming, we ask you to cancel them first, because deleting your Account does not by itself cancel a Plan, and you would still be charged for something you can no longer use.
4. AI Practice
In short: AI Partners are software, not people. They help you practice; they are not therapy, medical, legal or financial advice. In an emergency, contact emergency services, not Genee.
4.1 You are talking to AI. Every AI Partner is generated by software. An AI Partner may play a named character, with a voice and an animated face, to make practice realistic. It is never a real person, and it will not claim to be one. AI Partners are labelled as AI in the Service, the Service tells you at the start of each practice conversation that you are talking to AI, and an AI Partner answers truthfully if you sincerely ask whether it is a person.
4.2 Not therapy or professional advice. AI Practice, Output and Coaching Sessions are for professional development. They are not psychotherapy, counselling, medical care, diagnosis or treatment, and they are not legal, financial, tax or employment advice. Do not rely on them for those purposes. Coaches are not therapists or doctors.
4.3 If you are in crisis. Genee is not an emergency service and does not monitor conversations in real time for safety. If you are in danger or thinking about harming yourself, call your local emergency number. In the United States, call or text 988 (Suicide and Crisis Lifeline).
4.4 How practice works. Your voice is streamed to our voice providers while you practice, and the conversation is transcribed so the Service can give you feedback and scores. We store the transcript, the feedback and the practice recording in your Account. Section 2 of the Privacy Policy explains what we never store, including emotion data and biometric identifiers.
4.5 The try-it-out experience. Some visitors may try a short practice conversation without an Account. The notice shown before it explains what is recorded. These Terms apply to that use too.
5. The Coach Marketplace
In short: Genee sells you Plans and sessions; independent Coaches deliver the sessions. Genee is responsible to you for what you buy.
5.1 Who you buy from. You buy Plans, Paid Sessions and other paid services from Genee. Genee charges you, handles refunds under these Terms and is responsible to you for delivering what you paid for, using Coaches it approves.
5.2 Coaches are independent. Coaches are independent professionals, not Genee employees. They decide how to coach within the Coach Agreement. Genee reviews each Coach's application and credentials before listing them. Genee does not run identity or criminal background checks on Coaches, and does not guarantee any outcome of coaching.
5.3 Booking. You may book a Coaching Session at least 12 hours and no more than 60 days ahead, in the Coach's available times. Where the Coach's Google Calendar is connected, each booking creates a Google Meet link and invites you and the Coach by Google Calendar. We email you and the Coach a reminder about 24 hours before a session, when it was booked more than a day ahead.
5.4 Intro Calls before Paid Sessions. You may book a single Paid Session with a Coach only after you have had an Intro Call with that Coach, meaning an Intro Call that has taken place: it has ended and was not missed or cancelled. Plan Sessions may be booked with any Coach your Plan covers, without an Intro Call.
5.5 Changing or cancelling a session. You may reschedule or cancel a Coaching Session up to 24 hours before it starts.
- (a) If you cancel at least 24 hours before, a Paid Session is refunded in full, and a Plan Session or Intro Call is returned to you.
- (b) If you cancel less than 24 hours before, or do not attend, the session counts as used and is not refunded. (For an Intro Call, see Section 8.3.)
- (c) If the Coach cancels, you receive a full refund for a Paid Session, and a Plan Session or Intro Call is returned to you. If the Coach has not joined 10 minutes after the start, write to support@genee.coach and we will refund a Paid Session or return a Plan Session or Intro Call.
5.6 Recording. Recording is available from 12 October 2026 for coaches and clients taking part in Genee's recording pilot, and no other Coaching Session is recorded. A Coaching Session is recorded only if you and the Coach both agree on Genee's consent screen before it, under the Session Recording and AI Notes Terms. You may not record a Coaching Session in any other way, and neither may the Coach.
5.7 Dealing with Coaches. Please book and pay for coaching with a Coach you met on Genee through the Service for 12 months after you last met them on Genee. This keeps your sessions covered by these Terms and by our refund promises. You are free to work with any Coach outside Genee in other ways.
6. Plans and Prices
In short: Plans are monthly, in US dollars, and renew automatically until you cancel. Live sessions in a Plan reset each month and don't roll over.
6.1 The Plans. On the Effective Date the Plans are:
| Plan | Price per month (USD) | Live Plan Sessions per month (45 minutes each) | AI Practice |
|---|---|---|---|
| Starter | $120 | None | Included; fair-use limits start 12 October 2026 (Section 7) |
| Growth | $220 | 1 | Included; fair-use limits start 12 October 2026 |
| Intensive | $440 | 2 | Included; fair-use limits start 12 October 2026 |
Once you are signed in, the Coaching plans page and the checkout show the current Plans and prices. The price you agree to at checkout is the price you pay.
6.2 Automatic renewal. Each Plan renews automatically every month, on the same day of the month as you started, and we charge your saved payment method the price of your Plan until you cancel under Section 11. The checkout shows the monthly price. You can cancel at any time under Coaching plans in your Account, and Stripe emails you a receipt for each charge. From 12 October 2026 the checkout will also state that the Plan renews monthly until you cancel and ask you to agree to that, and we will email you a confirmation of these terms after you subscribe and a reminder of them at least once a year.
6.3 Plan Sessions don't roll over. Unused Plan Sessions end at the end of each billing month. They are not refunded and do not carry over.
6.4 Changing Plans. If you move to a higher Plan, we charge the difference for the rest of the current month at once, and the extra Plan Sessions are added when that payment succeeds. If you move to a lower Plan, the change takes effect at your next renewal.
6.5 Price changes. We may change Plan prices. We will tell you by email at least 30 days before a new price applies to your Plan. If you do not accept it, you may cancel before it applies. If you are charged a new price that we did not tell you about 30 days ahead, you may cancel within 14 days of that charge and we will refund the difference for the unused part of the month. From 12 October 2026 we will also ask you to agree to a new price. If you joined at an earlier price, you keep that price while your Plan stays active on the same Plan; changing Plans moves you to the current price.
6.6 Taxes. Prices are in US dollars, and we do not add sales tax, VAT or similar taxes at checkout today. If we start collecting them, we will show them at checkout before you pay.
6.7 Promotional codes. A promotional code applies only if the checkout shows the discount before you pay, and only on the terms shown with it.
7. Fair Use of AI Practice
In short: from 12 October 2026, Plans include AI Practice up to 600 minutes a month, of which up to 120 with an animated face, and up to 120 minutes a day. That is far more than most people use.
7.1 The limits. The limits in this Section 7 start on 12 October 2026; until then Genee does not count or limit Practice Minutes. From then, each Account may use, in each billing month:
- (a) up to 600 Practice Minutes;
- (b) of those, up to 120 Practice Minutes with an AI Partner's animated face; and
- (c) up to 120 Practice Minutes in a single day (days run midnight to midnight, Coordinated Universal Time).
A practice conversation lasts up to 15 minutes today and, from 12 October 2026, up to 30 minutes, and from then you may run one at a time.
7.2 How minutes are counted. Genee's servers count Practice Minutes while a practice conversation is live, in one-minute steps. The Service shows you how many minutes you have left.
7.3 When you reach a limit. When you have used your monthly or daily Practice Minutes, new practice conversations are unavailable until the next billing month or the next day, and a conversation in progress ends at the limit. When you have used your face minutes, practice continues in voice only. We do not charge for extra minutes.
7.4 Without a paid Plan. If you buy single sessions or your organisation sponsors you, your Practice Minutes follow the same limits and reset on the first day of each calendar month (Coordinated Universal Time).
7.5 Why we have limits. AI Practice costs us money for every minute. These limits keep the Service fast and affordable for everyone, and stop automated or shared use.
8. The Free Trial and Free Intro Calls
In short: you can take a free intro call with each Coach, with no card. From 12 October 2026 you can also try AI Practice free for 30 minutes over 14 days, with no card, and take up to three free intro calls in total. Nothing is charged automatically.
8.1 The free trial. The free trial starts on 12 October 2026. After you confirm your email address, you may use up to 30 Practice Minutes within 14 days of your first practice conversation, free. Your first trial conversation may use an animated face. The trial needs no payment card and never turns into a paid Plan by itself. Each email address, and each Google account, gets the trial once.
8.2 Free Intro Calls. You may book a free 30-minute Intro Call with a Coach, at most one with each Coach, without a payment card. From 12 October 2026 you may book up to three in total, Intro Calls are available once per verified email address, whether you confirm it with a code we email you or by signing in with a Google account whose email Google has verified, and Intro Calls you use stay used if you close your Account and open another.
8.3 What happens to an Intro Call. An Intro Call that you or the Coach cancels is returned to you, and one you miss counts as used. If the Coach does not attend, write to support@genee.coach and we will return it.
8.4 Abuse. We may withdraw the trial or Intro Calls from anyone who tries to obtain them more than once, for example with several email addresses.
9. Payments
In short: you pay by card through Stripe. You authorise us to charge your card each month until you cancel.
9.1 Payment processing. Stripe processes all payments for Genee. Stripe's terms apply to its processing of your payment. We never receive your full card number.
9.2 Authorisation. By starting a Plan you authorise Genee to charge your payment method the Plan price at the start and on each monthly renewal until you cancel. By buying a Paid Session you authorise a single charge.
9.3 Card authentication. Your bank may ask you to confirm a payment. If a first payment is declined or not confirmed, the Plan does not start and you are not charged.
9.4 Disputes about a charge. If you think we charged you in error, write to support@genee.coach within 60 days of the charge. We will investigate and refund any charge made in error.
10. Failed Payments, the Grace Period and Pausing
In short: if a renewal payment fails, Stripe retries it for about two weeks, and if it still fails your Plan ends. You can also ask us to pause your Plan for 1, 2 or 3 months.
10.1 Failed renewals. If a renewal payment fails, Stripe retries it automatically, up to 8 times over about two weeks (the "Grace Period"). During the Grace Period your Account, your history and AI Practice stay available, but you cannot book Plan Sessions until the payment succeeds. To update your payment method, write to support@genee.coach.
10.2 When the Grace Period ends. If the payment still has not succeeded at the end of the Grace Period, Stripe cancels the subscription and your Plan ends. You keep access to your Account and can read your practice history, but you cannot book Plan Sessions until you start a Plan again. We do not charge you for the Grace Period if the payment never succeeds.
10.3 Pausing your Plan. There is no pause button. You may ask us to pause your Plan once in any 12 months, for 1, 2 or 3 months, by writing to support@genee.coach at least 3 days before your next renewal, and our team does it by hand. While your Plan is paused you are not charged. Your Plan restarts at the end of the pause, at the same price. You may end a pause early or cancel during it by writing to us.
11. Cancellation and Refunds
In short: cancel any time in your Account. Your Plan runs to the end of the month you paid for. Your first Plan payment is refundable for 14 days if you haven't used a live session; EU and UK consumers also have their statutory rights.
11.1 How to cancel. You may cancel your Plan at any time in your Account, under Coaching plans, with no need to call or write to us. You may also cancel by writing to support@genee.coach. Cancellation takes effect at the end of the current billing month. Until then you keep everything your Plan includes, and you may undo the cancellation by writing to support@genee.coach.
11.2 14-day refund of your first Plan payment. If you cancel within 14 days of your first payment for a Plan and you have not attended a Plan Session in that period, we refund that payment in full on request to support@genee.coach. This applies once per person.
11.3 Other Plan payments. Apart from Sections 1.2, 11.2, 11.4 and 11.6, Plan payments are not refundable, and we do not refund partly used months or unused Plan Sessions.
11.4 Consumers in the European Union, the European Economic Area, Switzerland and the United Kingdom. You have a legal right to withdraw from a Plan or Paid Session within 14 days of buying it, without giving a reason. Write to support@genee.coach. From 19 October 2026 you can also use the "Withdraw from contract" button in your Account, under Coaching plans. If you asked us to start the Service within the 14 days, we refund the price minus a proportionate amount for what you used before you withdrew. For a Paid Session that has already taken place in full, the right to withdraw ends once the session is delivered only if you agreed to that at checkout; the checkout does not yet ask for this agreement.
11.5 Paid Sessions. Section 5.5 sets out when a Paid Session is refunded.
11.6 If we end the Service. If we close your Account other than for your breach of these Terms, or stop offering the Service, we refund the unused part of your current billing month and any Paid Session you have not received.
11.7 How refunds are paid. Refunds go to the original payment method, normally within 10 business days of our decision.
12. Acceptable Use
In short: use Genee lawfully and respectfully. Don't record people without their agreement, misuse the AI, or attack the Service.
- (a) break any law, or use the Service to harass, threaten, defame, discriminate against or harm anyone, including Coaches;
- (b) record, photograph, screenshot or transcribe a Coaching Session or another person's Content by any means other than the Notetaker (available only in Genee's recording pilot) under the Session Recording and AI Notes Terms;
- (c) upload Content you have no right to share, including other people's personal information without their permission;
- (d) use the Service to create sexual content, content that sexualises minors, or content promoting violence or self-harm;
- (e) try to make an AI Partner produce unlawful or harmful content, or to extract its instructions or other users' data;
- (f) use AI Practice or Output to impersonate a real person or to deceive anyone into believing they are dealing with a person;
- (g) access the Service by automated means, scrape it, overload it, probe its security, or get around its limits, including the fair-use limits once they start;
- (h) copy, reverse engineer or resell the Service, or use it or its Output to build a competing product or to train an AI model; or
- (i) share your Account, or create Accounts to obtain more free trials or Intro Calls.
12.2 What we may do. If you breach this Section, we may remove Content, suspend features or suspend or close your Account. We tell you why, unless the law or safety prevents it, and give you a chance to respond before closing an Account, except in serious or urgent cases. Section 11.6 does not apply to a closure for your breach.
13. Your Content and Genee's Intellectual Property
In short: what you create stays yours. You let us use it to run the Service for you and, if Help improve Genee is on for you, to improve Genee. Genee's software and brand stay ours.
13.1 Your Content is yours. You keep all rights in your Content. You give Genee a non-exclusive, worldwide, royalty-free licence to host, store, process, transmit and display your Content, and to share it with the providers listed in the Privacy Policy, to provide and secure the Service for you and, under Section 13.2, to improve Genee, for as long as we keep it under the Privacy Policy.
13.2 Improving Genee, and no training by others. Our providers may not use your Content or your Recorded Sessions to train their own AI models, and we do not allow them to; Genee itself never uses your Content to train any provider's models. The setting "Help improve Genee" in Settings starts on the day its switch is live, which we plan for 12 October 2026. Until then Genee does not use your Content to improve Genee, except that a Recording or Transcript made in Genee's recording pilot may be used where both Participants have opted in, as (c) says. From then, Genee itself will use your AI Practice Content (your conversations with an AI Partner, their transcripts, and the feedback and scores) to improve Genee (quality checks and labelling by Genee staff, and evaluations) only through the setting "Help improve Genee", on these terms: (a) in the United States it is on by default for an Account opened on or after the day the switch is live; it is disclosed in the Privacy Policy, you acknowledge a notice about it when you sign up, and you can switch it off in one tap in Settings or by emailing privacy@genee.coach; for an Account that already existed that day we email you first, and for you it is off until 11 November 2026 unless you turn it on yourself in Settings; "in the United States" means that the country on your Account is the United States; (b) outside the United States, including where the country on your Account is unknown or missing, it is off unless you turn it on in Settings; (c) practice content that reveals health information is not used unless you explicitly agree, and Genee does not use full recordings of Coaching Sessions, or health or mental-health content from Coaching Sessions, to improve Genee, whatever your setting says, except that a Recording or Transcript made in Genee's recording pilot may be used to improve Genee (for quality checks, labelling and evaluations) only where both Participants have opted in to "Help improve Genee", which pilot participants are asked about directly, and never to train any provider's models; otherwise Genee will do so only if we later offer a separate, explicit consent for it and you give it; (d) data collected before the day the setting starts for you is never used, except the pilot recordings described in (c) (Section 4.5(d) of the Privacy Policy says which day that is); and (e) switching it off stops any new use, and never affects your Plan.
13.3 Output. As between you and Genee, you own the Output generated for you, to the extent the law allows. Similar Output may be generated for other people.
13.4 Genee's property. The Service, including its software, AI Partners and their characters, scenarios, rubrics, design and the Genee name and logos, belongs to Genee and its licensors. We give you a personal, non-transferable, revocable licence to use the Service under these Terms. No other rights pass to you.
13.5 Feedback. If you send us ideas or suggestions, we may use them freely, without paying you or naming you.
13.6 Copyright complaints. If you believe Content on the Service infringes your copyright, write to legal@genee.coach with the details required by the US Digital Millennium Copyright Act (17 U.S.C. § 512(c)(3)). We remove infringing Content and close the Accounts of repeat infringers.
14. AI Output
In short: AI can be wrong. Check anything that matters before you rely on it.
14.1 Output may be inaccurate. Output is generated by AI models and may be incomplete, wrong, biased or not suited to your situation. Scores and feedback are practice aids, not assessments of your abilities, character or employability.
14.2 Use your judgement. You are responsible for how you use Output. Do not rely on it as a substitute for professional advice (Section 4.2).
14.3 No decisions about you by AI alone. Genee does not use AI to make decisions that have legal or similarly significant effects on you. Once AI-drafted notes from a Coaching Session exist, they reach you only after your Coach has reviewed and confirmed them.
14.4 Reporting a problem. If Output is offensive, harmful or plainly wrong, tell us at support@genee.coach so we can fix it.
15. Recorded Coaching Sessions
In short: from 12 October 2026, sessions are recorded only in Genee's recording pilot, and only if both you and your Coach agree, every time. A separate document sets out the details.
15.1 Recording is available from 12 October 2026 for coaches and clients taking part in Genee's recording pilot. AI-drafted notes are not available yet, and during the pilot Coaches write session notes themselves. The Session Recording and AI Notes Terms govern when a Coaching Session is recorded, by the Genee notetaker (the "Notetaker"), and what happens to the recording, the transcript and AI notes. Nothing is recorded unless you and your Coach both agree on Genee's consent screen before the session, and either of you can stop the recording at any time.
16. Disclaimers
In short: we provide the Service carefully, but as it is. Your legal rights as a consumer are not affected.
16.1 Except as expressly stated in these Terms, and to the extent the law allows, the Service and Output are provided "as is" and "as available", and Genee disclaims all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. Genee does not warrant any result from coaching or practice.
16.2 Nothing in these Terms excludes or limits any warranty, right or remedy that the law where you live does not allow to be excluded or limited, including, for consumers in the European Union and the United Kingdom, your statutory rights for digital content and services.
17. Limitation of Liability
In short: if something goes wrong, our liability is capped at what you paid us in the last 12 months, or $100 if more. Some things can never be capped.
17.1 Cap. To the extent the law allows, Genee's total liability to you for all claims arising out of or relating to these Terms or the Service is limited to the greater of (a) the amounts you paid Genee in the 12 months before the event giving rise to the claim and (b) US$100.
17.2 Excluded losses. To the extent the law allows, Genee is not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, opportunity or goodwill.
17.3 What is never limited. Sections 17.1 and 17.2 do not limit liability for (a) death or personal injury caused by negligence, (b) fraud or fraudulent misrepresentation, (c) gross negligence or wilful misconduct, (d) Genee's breach of its data-protection obligations under the Privacy Policy, or (e) anything else that cannot be limited by law.
18. Indemnity
In short: if you misuse Genee and someone sues us because of it, you cover our costs. This does not apply to consumers in the EU and UK.
18.1 You agree to compensate Genee for reasonable losses and costs, including reasonable legal fees, arising from a third-party claim caused by your breach of Section 12 or your Content infringing someone's rights. Genee will tell you promptly about the claim and let you take part in its defence. This Section does not apply to consumers in the European Union, the European Economic Area, Switzerland or the United Kingdom.
19. Disputes and Governing Law
In short: talk to us first. If we can't resolve it, New York law applies and you can go to the New York courts or small-claims court. We don't force arbitration, and you keep your right to join a class action. EU and UK consumers keep their local protections and courts.
19.1 Talk to us first. Before starting a claim, write to legal@genee.coach with your name, your Account email and a description of the dispute. We will try in good faith to resolve it within 30 days. This does not stop either party from seeking urgent relief from a court.
19.2 Governing law. These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the State of New York, without regard to its conflict-of-law rules, and by applicable US federal law.
19.3 Courts. Any dispute that is not resolved under Section 19.1 may be brought in the state or federal courts located in New York County, New York, and you and Genee consent to their jurisdiction. You may instead bring a claim in a small-claims court where you live, if it qualifies.
19.4 No mandatory arbitration. Neither you nor Genee is required to arbitrate disputes, and nothing in these Terms waives your right to participate in a class action or to a jury trial.
19.5 Consumers outside the United States. If you are a consumer living in the European Union, the European Economic Area, Switzerland or the United Kingdom, you also have the protection of the mandatory laws of your country of residence, and you may bring proceedings in the courts of your country of residence. EU consumers may also use their national alternative dispute resolution bodies.
19.6 Time limit. To the extent the law allows, a claim must be brought within two years after it arises.
20. General Terms and Contact
In short: the usual legal housekeeping, and how to reach us.
20.1 Changes to these Terms. We may change these Terms. For a material change we will email you and show a notice in the Service at least 30 days before it takes effect, unless the change is required by law sooner. If you do not agree, you may cancel before the change takes effect and, for a change that reduces your Plan, receive a pro-rated refund under Section 1.2. Using the Service after a change takes effect means you accept it.
20.2 Ending these Terms. These Terms apply until your Account is closed. Sections 13, 14, 16 to 20 and any accrued payment obligations survive.
20.3 Assignment. You may not transfer your rights under these Terms. Genee may transfer them to a company that acquires all or most of its business, and will tell you if it does; your rights under these Terms are not reduced.
20.4 Events beyond control. Neither party is liable for failure caused by events beyond its reasonable control, such as outages of internet or cloud providers, natural disasters or government action. Section 11.6 still applies.
20.5 Whole agreement; severability; no waiver. These Terms, with the documents in the opening paragraph, are the whole agreement between you and Genee about the Service. If a provision is unenforceable, the rest remains in effect. A delay in enforcing a right is not a waiver of it.
20.6 Notices. We send notices to the email address on your Account. You send notices to legal@genee.coach.
20.7 Language. These Terms are written in English. A translation is for convenience; the English version governs to the extent the law allows.
